Roku is appealing the recent dismissal of a case asking a US court to set patent pool rates. The US streaming platform had asked a Massachusetts court, among other things, to set a FRAND royalty for the HEVC pool administered by Access Advance. Last month, Judge Richard G Stearns ruled that his court lacked jurisdiction to make such a determination. The decision cited the large number of non-US patents included in the pool and the fact that such an opinion would have no binding effect.
A notice of appeal to the Court of Appeals for the Federal Circuit was filed by Roku last week. Meanwhile, the UK Supreme Court will consider the Tesla case, which raises similar questions, next year. This will be a key issue to watch in the SEP world for 2026.
Staying in the video space, several new licensing developments were announced last week. Two Chinese tech giants, Alibaba Group and ZTE, signed up to the Access Advance Video Distribution Pool as patent owners. Meanwhile, VideoLabs announced a syndicated deal spanning 11 new licences.
