Over recent years India has begun to emerge as a significant venue for SEP enforcement actions. That progress is unlikely to be slowed by a decision from the country’s Supreme Court published last week refusing permission for the Indian competition authority to reopen an investigation into allegations that Ericsson charges excessive royalty rates to local implementers. However, whether this is a case specific ruling that hinges on the fact Ericsson had already settled disputes with smartphone manufacturers Micromax, iBall and Intex, or whether it is more generally applicable and so rules out future investigations of SEP holders, is not clear. This is one to keep an eye on.

Elsewhere, Amazon launched suit against InterDigital in the UK, though details of the grounds have yet to become public; while Via’s Qi Wireless pool secured another licensee. There was also a notable IAM opinion piece by Eric Stasik, arguing that regional pool rates may be justified in some situations but that they do not make sense for the auto sector.

Please note that inclusion of a piece in the list below does not signify agreement with what is stated in the linked article, just that we believe it is of interest and worth pointing out.
