Last week, it emerged that on the back of the injunction it is now enforcing in Germany against Asus, Korean R&D institute Wilus – a licensor in various Sisvel pools, including the recently launched Wi-Fi Multimode programme – has requested the Eastern District of Texas federal court to issue a permanent injunction against Asus subsidiary Askey in a Wi-Fi patent infringement suit.
“Based on a stipulation under which Askey admits to the infringement of several valid SEPs, Wilus is now asking Judge Rodney Gilstrap for a permanent injunction (on an expedited track),” ip fray reported, adding: “This case has landmark potential. It can make an impact even beyond SEPs if some of Wilus’s arguments, such as the irreparable harm from a licensing firm lacking the funding for more innovative work due to hold-out, are accepted.”
Notably, in its filing, Wilus cited last year’s joint statement of interest submitted by the US Department of Justice and the USPTO in the Radian Memory v Samsung Electronics dispute, which called for the wider availability of injunctions in patent litigation. This is a case to which the global FRAND/SEP community will now be paying very close attention. The entire market understands that the grant of a US injunction to an SEP holder would be a gamechanger.
Elsewhere in the legal world, Ericsson filed suit at the Unified Patent Court against Verifone in its first IoT-related enforcement; and in the UK, a high-profile action challenging Qualcomm’s stipulation that tied Apple and Samsung access to chipset technology with SEP licence agreements was dropped. Meanwhile, in an in-depth interview with JUVE Patent, Judge Oliver Schön of the Munich Regional Court outlined his thinking on many key SEP-related issues.
