About the Sisvel Point-of-Sale (POS) Patent Programme

The Sisvel POS licensing programme offers a single solution to license cellular standard essential patents (SEPs) for the use of POS devices. The licence offer includes the cellular SEPs owned by Sisvel and the programme’s participating patent owners – a group of leading innovators that have helped to pave the way towards the connected world that we all enjoy today.
The Sisvel POS programme offers an efficient and transparent way for implementers to access the relevant SEPs of the participating patent owners under fair, reasonable and non-discriminatory terms.

Sisvel has the right to grant non-exclusive licences to all cellular standard essential patents ("SEPs") held by the participating patent owners.
The participating patent owners have collectively declared more than 60,000 patent families as essential to cellular standards in accordance with the Intellectual Property Rights Policy of the European Telecommunications Standards Institute (ETSI). For further information, please refer to the ETSI IPR Online Database.
The Sisvel POS programme also includes an essentiality evaluation process conducted in connection with independent patent evaluators. An illustrative list of essential patents identified through that process is available to POS device makers upon request. A public patent list is intended to be published in due course.

The royalty rates for the Sisvel POS licensing programme are offered on a per unit fee basis as follows:

Who should obtain a licence under the Sisvel POS programme?
If you manufacture any POS devices implementing cellular functionalities, or if you are in the process of bringing such a device to market, you should contact us to obtain a licence under the programme.
What value does a licensee receive from a licence?
A licence under the Sisvel POS programme covers all patents that are essential to the relevant cellular standards held by entities currently participating in the programme (see Patent Owners) and all new ones that join in the future. Any new patents essential to the standards that these entities may come into possession of during the lifetime of the licence are also covered.
What products are covered?
The licence covers devices in the following categories: Payment Sound Box, Low-End Device, Mid-End Device and High-End Device. For clarity, and notwithstanding anything to the contrary, multipurpose devices, such as laptop computers, smartphones and tablets, which are adapted via application software or by adding a detachable module are not covered by the licence even if these are used to process payment transactions.

How does the programme handle 4G and 5G POS devices?
The Sisvel POS programme is a multigenerational cellular programme. To encourage early adoption of the POS programme licence, Sisvel is offering licensees a single rate for both 4G and 5G POS devices. The rate applies only to the cellular standards implemented in the POS device, meaning a 4G-enabled POS device is licensed only under the relevant cellular patents and not under patents essential solely to the 5G cellular standard. As a result, early licensees offering only 4G-enabled POS devices will continue to pay the same per device rate if and when their 5G-enabled POS devices are made available during the initial term of their licence agreement.
What are the steps to become a licensee?
The first step is for Sisvel and a potential licensee to establish contact. Once this happens, Sisvel will explain how a licence under the programme works. A licensee will also be able to ask questions – for example, about the scope of the licence and the products it will cover.
The process is completed when the parties have signed the licence agreement. After this, the parties will stay in contact during the course of the licence in connection with, for example, the licensee’s royalty reporting.
What do I need to do to obtain a licence?
When a potential licensee is ready to sign an agreement and has provided relevant company information (e.g., name, address and contact details), Sisvel stands ready to support the preparation of a signature version of the agreement and assist throughout the signature process.
Today, most of our licence agreements are formalised using electronic signatures, but they can also be signed with ink on a hard copy.
The licence agreement is concluded when both the licensee and Sisvel have signed the agreement. It remains in force for the duration of the licensed term, or otherwise as set forth in its terms and conditions.
What is the term of the licence?
The standard term of the licence is five years.
What are the reporting requirements under the licence?
Licensees must report the sales of licensed products made or sold on a calendar quarterly basis.
Is there any joining fee or other initial payment to become a licensee?
No.
Are there any additional costs associated with the licence in addition to the royalty?
No.
Are there any subscription or use fees for the licence?
No.
What should I do if my supplier claims to have an agreement with Sisvel?
You should verify the supplier's licensed status directly with Sisvel.
